Pet Agreement


This Pet/Service Animal Agreement is supplementary to the Lease Agreement and shall be in full force and effect during the remainder of the Term of the Lease unless terminated earlier pursuant to the provisions hereof or by agreement between Owner and Tenant. A photograph of the Pet shall be provided by Tenant and shall be held on file by the Lessor or, alternatively, the Pet shall be presented physically to Lessor for approval. 1. Residents are hereby authorized to keep a pet on the premises, subject to the terms of this agreement. Authorization may be terminated if a resident’s right of occupancy is lawfully terminated or if any terms of this agreement are violated in any way by resident or resident’s guests. Permission to keep a pet is restricted to the particular pet described below and does not extend to any other animal. 2. No limit on Liability: Any additional monthly rent, deposit or fee under this agreement is not a limit on resident’s liability for property damage, cleaning, deodorization, de-fleaing, replacements and/or personal injuries set forth below. Residents shall be liable for the entire amount of all damages caused by pet. This applies to carpets, doors, walls, drapes, blinds, screens, furniture, appliances, landscaping and any other part of the rental premises. If such items cannot be satisfactorily cleaned or repaired residents must pay for complete replacement by owner. Payment for damages, repairs, cleaning, replacements, etc. shall be due immediately upon demand. 3. Residents shall be strictly liable for the entire amount of injury to any person or their property when caused by resident’s pet, and Residents shall indemnify owner of all cost of litigation and attorney’s fees resulting from such injury. 4. Pet shall be controlled at all times. Pet shall not be allowed out of the apartment unless in custody of resident and on a leash, in a box, caged or otherwise under physical restraint. Owner or owner’s representative shall have the right to pick up loose pets and/or report them to the proper authorities. Owner may impose reasonable charges for picking up and/or keeping loose pets. 5. Pet must be house broken. Resident agrees to immediately clean up after the pet, both inside and outside the premises and to dispose of any pet waste promptly and properly. Resident agrees to provide appropriate litter box for Cats and maintain it in a clean, sanitary condition. Cat litter must be disposed of on a frequent basis, by first placing in a plastic bag, then placing in the dumpster or trash receptacle. 6. Resident shall comply with all applicable local ordinances, regulations and laws governing pets. Pets must be spayed or neutered, currently licensed and immunized in accordance to local law requirements. Resident is required to provide proof of spay/neuter. 7. Resident agrees to properly care for and provide a humane living environment for the Pet. Resident warrants the pet to have no history of causing physical harm to persons or property, and further warrants the pet has no vicious history or tendencies. 8. The pet, whether inside or outside, will not disturb the rights, comforts and convenience of other residents. 9. Violation of Rules: If, in Owner’s sole judgment, any rule or provision of this Pet/Service Animal agreement is violated by Resident or their guests, Resident shall immediately and permanently remove the Pet from the Premises upon 10 day’s written notice from owner. If resident refuses to remove the pet, eviction procedures will begin at owner’s option and at resident’s expense. 10. Inspection: At any time with 48 hours written notice of entry, owner will conduct inspections to ensure that occupants are following the pet rules outlined in this agreement. 11. Other Remedies: This Pet/Service Animal Agreement is an Addendum to the Rental Agreement between Owner and resident. If any rule or provision of this agreement is violated, Owner shall, in addition to the foregoing, have all rights and remedies set forth in the Rental Agreement for violations thereof, including, but not limited to, eviction, damages, and attorney’s fees. 12. Verified Service Animals shall not be charged a Pet Fee, Additional Pet Rent or Pet Deposit. Resident agrees to pay non-refundable pet fee of $350 prior to taking occupancy or acquiring pet. Resident agrees to pay $15 additional pet rent per month.
